Lawyers to head Customary courts in Ondo state
Lawyers, with at least five years post-call experience will henceforth be appointed as President of Grade A Customary courts in
Chief Sola Ebiseni, the Chairman of the state Law Commission told journalists in Akure The state Capital that the new 500 sets of revised laws published in a compendium had removed obsolete and outdated laws.
Ebiseni stated further that the revised law provided that Qualified legal practitioners with at least five years post call experience at the Nigerian Bar will henceforth be in charge of customary courts to guarantee fair hearing.
He said “The Nigerian Constitution guarantees fair hearing to Litigants (plaintiffs and defendants) and it will be unfair for lawyers to appear before a court headed by non-lawyers.
“ The quality of justice delivery and fair hearing cannot be justified when a lawyer will go before a court and talk about law to somebody who does not understand law”
Ebiseni also explained that the lawyers appearing before any court in the state must quote and cite from the revised laws as against previous practice whereby they usually cite laws from loose sheets containing bills from the parliament or decrees.
The State governor, Dr Olusegun Mimiko, recently presented to the public, the newly revised laws which replace the obsolete ones being used in the administration of justice in the state since 1978.
The Law commission chairman stated further that the state government had approved one hundred million Naira for the
Establishment of a modern, well equipped law report centre similar to that of the Nigerian Institute of Advanced Legal studies
